Taiwan has indicted nine individuals, including an Nvidia senior manager and two Supermicro employees, for allegedly participating in a scheme to smuggle high-end AI servers to China. Prosecutors in Keelung confirmed the suspects were charged with breach of trust and document forgery, though no names were released. One suspect remains at large, accused of siphoning funds from a distributor involved in the scheme. The indictment follows a broader investigation into illegal exports of AI hardware to China, which has intensified since the US imposed export controls on semiconductors to China in 2022.

Since 2022, the US has required licenses for exporting semiconductors to China to protect national security. However, the scheme involving Supermicro and Nvidia has exposed vulnerabilities in these controls. Taiwan’s investigation found that co-conspirators attempted to falsify documents to make it appear that 130 B300 servers were installed in Taiwan. Of those, 74 were ultimately exported to Chinese customers, while 56 were blocked after customs officials detected irregularities. Supermicro has confirmed it is cooperating with Taiwanese authorities and has fired several employees linked to the scheme, though an internal investigation cleared its current senior officials of any involvement.

The case highlights the challenges of enforcing export controls in a globalized supply chain. Taiwan prosecutors stated that all indicted employees were aware of Nvidia and Supermicro’s rigorous internal procedures, yet the scheme became more brazen despite tightened controls. The US and Taiwan have recently strengthened export regulations, but the Supermicro scandal shows that evasion remains possible. Supermicro’s team allegedly grew increasingly confident in its ability to bypass controls, leading to more daring deals to supply China with advanced computing power. The case also underscores the growing importance of remote access to AI infrastructure for Chinese tech firms, as they seek to expand their capabilities through data centers in Southeast Asia.
